What Do I Know About Construction Health And Safety?

I work in an office, and don’t even know how to use an angle grinder. But according to Occupational Health and Safety Act, I am (as the Client) responsible for the safety of the contractor's team...that doesn't make sense?!

Indemnify Yourself

Fortunately, OHS Act also makes provision for you, the client, to "indemnify" yourself to a large degree by signing an OHS Act Section 37(2) agreement with the contractor. This simple but essential agreement effectively puts the onus on the contractor to comply with, inter alia, the OHS Act, and indemnifies you against the contractor's acts or omissions in terms of the Act.

Its Seems To Be A Legal Minefield

Quite frankly, it is. If you're a layman, rather be safe than sorry, and get some expert advice. There are several reputable SHE firms to choose from, but be sure you are important to them. SHe Files (PTY) Ltd focuses on the smaller contractors and clients, who do not have unlimited budgets and who need quick turnaround times
